John McGill has specialized in construction law matters for the past 20 years.  Before that, and starting in high school, John was building and working in the trades.  Trained as a carpenter, he got his General Contractors license in 1983 and worked in the North Bay as a project manager and contractor, building and running projects; wineries, commercial mid-rise, residential single family, and multifamily. In 1997 he received his law degree and continued to work in the industry.

McGill Law Firm represents contractors, owners and suppliers in construction related issues- advisory, transactional and litigation- and in general business matters throughout the greater Bay Area- from Sacramento to San Jose, Marin to Contra Costa.  We also handle landlord-tenant matters, residential purchase and sale disputes, employment issues, and business entity formations.

It is always best to prevent an issue from becoming a problem, and the best way to do that is to understand your options.  It's true in law as in everything else: An ounce of prevention is worth a pound of cure. GENERAL COUNSEL SERVICES- CONSTRUCTION

Working with contractors and suppliers to answer and address legal issues that come up in the day to day business of contracting.  John was in house counsel for a large general contractor and saw firsthand what issues can come up and how addressing them at the time rather than waiting is the best approach. Having an attorney on call when you need him is a cost-effective approach to avoiding the avoidable.                   


LITIGATION

Sometimes you can't avoid a dispute. Litigation is a last resort when all else fails but sometimes it's just the cost of doing business.  John has successfully resolved many cases at mediation but has also taken a case to trial or arbitration.  If your dispute needs an attorney that is going to provide you with the advocacy and the candor that you want, lets talk.


 PRIVATE WORKS          CONSTRUCTION LAW & DISPUTES

Private Works is a complicated arena of rights and counter rights.  Contractors have right; Owners have rights.  Protecting those rights and avoiding issues when they conflict is the best approach to avoiding costly litigation.  John has experience as a builder and an attorney to do that, but has the experience to litigate the dispute if it gets to that point.

ENTITY FORMATION

Going from a sole proprietorship to a partnership or corporation? Thinking about creating an LLC?  These are not difficult processes but there are considerations that need to be dealt with and if they are not, they can cause problems later on. Public Works contracting is a world unto itself.  It has its own Code and it has its own requirements.  John has been involved in that world for over15 years and can help you prevent issues from arising and if problems do come up, can help you preserve your rights and defend them too.

Eviction is a complicated issue, sometimes very emotional, and never a simple process.  There are steps that need to be taken if the eviction is going to be accomplished as the law requires.  Residential and commercial procedures are similar but not always the same.  If you have an eviction issue, let’s discuss it and see if we can work together to resolve it.

NON DISCLOSURE

Non-disclosure issues can be a problem for the seller and for the buyer. The California Real Estate documents are long and confusing and the law dealing with disclosures is equally long and confusing. It doesn’t come up often, but when it does it can be very trying and the process can be very long and drawn out. John has represented sellers and buyers in non-disclosure matters over the past years and would be happy to discuss your case with you.
